Using this Site does not make us your real estate broker or agent. A brokerage relationship in New Mexico is created only by a signed written agreement between you and the brokerage. Until such an agreement is signed, we owe you the duties a New Mexico broker owes to a non-client, and information you share with us is not subject to the confidentiality that a client relationship would carry.
Any description of the probate process on this Site — including timelines, court requirements, the duties of a personal representative, and the glossary and FAQ — is a general summary. New Mexico probate procedure varies by county, by the size and complexity of the estate, and by whether the decedent left a valid will.
We do not control the courts and cannot promise how long any probate will take, whether a court will grant a petition, or what a personal representative will be authorized to do.

This limitation applies to your use of the Site and its content. It does not limit liability for fraud, for intentional misconduct, or for anything else that cannot be limited under applicable law, and it does not apply to the duties owed under a signed brokerage or service agreement, which are governed by that agreement.
You agree to indemnify and hold harmless New Mexico Probate Solutions and John Sheffer from claims, losses, and reasonable attorney fees arising out of your misuse of the Site, your violation of these Terms, or your violation of the rights of another person — including submitting someone else’s personal or contact information without their permission.

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the jurisdiction of those courts.
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. Any signed brokerage, listing, service, or funding agreement controls over these Terms where they conflict.
We may revise these Terms at any time by posting an updated version on this page and changing the effective date. Material changes will apply going forward, not retroactively.
